NOTICE OF REQUEST FOR QUALIFICATION (RFQ) FROM PROSPECTIVE DEVELOPERS FOR PROJECTS. UNSOLICITED PPP PROCESS
PUBLIC PRIVATE PARTNERSHIP (PPP) FOR INFRASTRUCTURE DEVELOPMENT OF FEDERAL MINISTRY OF ENVIRONMENT’S LANDS AT

(1) INTRODUCTION
The Federal Government of Nigeria (FGN) through The Federal Ministry of Environment (FMEnv) is desirous of embarking on an Infrastructure development (provision of houses and/or shops) on its lands through the Public Private Partnership (PPP) arrangement.
In compliance with the Infrastructure Concession Regulatory Commission Establishment Act (2005) and the National Policy on Public Private Partnership, (N4P), FMENV submitted an Outline Business Case (OBC) to the ICRC for consideration. ICRC having assessed and affirmed the bankability of the provision of this Infrastructure through the PPP arrangement, has issued an Outline. Business Case (OBC) Compliance Certificate to enable the FMEnv commence the procurement of a Private Partner for the Project. The houses and shops will be built at four locations as mentioned above namely, Animal Rescue Centre Katsina Road, Kano, APCU premises Km 11, Gwarzo Road, 3rd Gate, Kano, Forestry Premises, Katsina Road. Kano and the Federal School of Forestry, Bauchl Road, Jos.
(2) PROJECT OBJECTIVE
The overall objective of each project is to procure a Private Partner with the technical and financial capabilities, to design, finance, build, operate and transfer cost effective houses and/or shops within the’ FMEnv lands. The Federal Government through each project aims to check encroachments, underutilization, create jobs for the Communities and to also increase the internal revenue generation of the FMEnv.
(3) PROJECT SCOPE
The main scope of each project Includes to design, finance, build, operate and transfer within each FMEnv land;
(i) between 80 and 200 units of cost-effective duplexes/flats and/or (ii) between 80 and 190 shops
(4) SWISS CHALLENGE PPP PROCUREMENT METHODOLOGY
Please note that for each project there is a private proponent who submitted a proposal on the project. However, in order to ensure transparency, competition, fairness and value for money, FMEnv has decided to procure each project through a Swiss Challenge PPP Procurement Methodology which requires that if the project (proponent) is not the most responsive bidder, it will be given the right of first refusal to match the most responsive bid to win the concession. However, if the project proponent is unable to match the most responsive bid, the most responsive bid then wins the concession and becomes the preferred Bidder.
(5) INVITATION
In furtherance of the above therefore, FMEnv hereby invites suitable, reputable and competent firms/consortia to make submissions for pre-qualification for the infrastructure development through the Public Private Partnership (PPP) arrangement.
(6) ELIGIBILITY REQUIREMENTS
Prospective Bidders should submit the following pre-qualification documents:
(i) Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including form CAC 1.1 or CAC2 and CAC7. Business Name is also acceptable.
(ii) Evidence Of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all the Partners in case of Business Name) for the last three (3) years valid till 31st December, 2023;
(iii) Evidence of Pension Clearance Certificate valid till 31st December, 2023 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
(iv) Evidence of Industrial Training Fund (ITF) Compliance Certificate till 31st December, 2023 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidders annual turnover is 40m and above)
(v) Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificated valid till 31st December, 2023.
(vi) Evidence of registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2023 or valid Certificate issued by BPP.
(vii) Sworn Affidavit
· disclosing whether or not any officer of the relevant committees of the Federal Ministry of Environment Infrastructure Concession Regulatory Commission or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars.
· that none of the Company’s directors has been convicted in any law court for any criminal offence relating to fraud or financial impropriety or criminal misinterpretation or falsification of facts relating to any matter and;
· that the company is not in receivership; bankrupt; or insolvent.
· Company’s Audited Accounts for the last three (3) years – 2020, 2021, 2022, in accordance with International Financial Reporting Standards (IFRS).
(viii) Reference letter from a reputable Commercial Bank in Nigeria indicating willingness to provide credit facility for the execution of the project when needed;
(ix) Company’s profile with the Curriculum Vitae of Key Staff to be deployed for the project, Including copies of their Academic/ Professional qualifications such as C0REN, QSRBN, ARCON, CORBON etc.;
(x) Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, j Valuation/Job Completion Certificate and Photographs of the projects:
(xi) List of Plant/Equipment with proof of Ownership/Lease Agreement;
(xii) Evidence of firm’s current registration with relevant regulatory Professional body (ies) such as COREN, QSRBN, ARCON, CORBON, etc.;
(xiii) For Joint Venture/, Partnership, evidence of Letter of Association or Memorandum of Understanding (MoU) should be provided. (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV Partner).
(xiv) All documents for submission must be transmitted with a covering/Forwarding Letter under the company/firm’s Letterhead Paper bearing amongst others, at the top of the page, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), TIN, Contact Address, Telephone Number (preferably GSM No.) and email address. The Letterhead paper must bear the names and Nationalities of the Directors of the company at the bottom of the page duly signed by the authorized officer of the firm.
METHOD OF SUBMISSION
For each project, prospective bidders are to submit two (2) hard copies one original copy and one photocopy of the Request for Qualification documents and should be neatly packed in the listed order above in separate sealed envelopes and marked Request for Qualification for Infrastructure Development through a PPP arrangement at the top right-hand corner of the envelope. Thereafter put the sealed envelopes together in a bigger envelope and addressed to: The Minister, Federal Ministry of Environment, Abuja attention Director of Procurement, and clearly marked with the name of the project.
Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and dropped In the Bid Box at the office of the Director of Procurement, Ground Floor Federal Ministry of Environment, Shehu Yar’Adua, Way, Mabushi, Abuja not later than 12:00 noon, on Wednesday 10 April, 2024.
(1) OPENING OF RFQ DOCUMENTS
The RFQ documents shall be opened immediately after the deadlines for submission at 12:00 noon, on Wednesday 10 April, 2024, at the office of the Director of Procurement, Ground Floor, Federal Ministry of Environment, Shehu Yar’Adua, Way, Mabushi, Abuja in the presence of the bidders or their representatives who choose to attend. Please ensure that you sign the Request for Qualification (RFQ) documents Submission Register as the FMEnv will not be held liable for misplaced or wrongly submitted Request for Qualification (RFQ) documents. (2) GENERAL INFORMATION
(i) Request for Qualification (RFQ) must be In English Language and Signed by an official authorised by the bidder;
(ii) Request for Qualification (RFQ) documents submitted after the deadline for submission would be returned un-opened;
(iii) Only the pre-qualified bidders will be invited at a later date for a Requester Proposal (RfP) Submission;
(iv) All costs incurred as a result of response to this Invitation and any subsequent requests for Information shall be borne by the responding Firm/Company.
(v) The Federal Ministry of Environment is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
