INVITATION TO TENDER FOR HOUSING AND INFRASTRUCTURE DEVELOPMENT UNDER A PRIVATE SECTOR PARTICIPATION (PSP) SCHEME

(1.0)       Background

Federal Housing Authority (FHA), a wholly owned agency of the Federal Government of Nigeria, was established vide Decree 40 of 1973 now cited as Act CAP F-14 Laws of the Federation of Nigeria 2004. The Authority which became partially commercialized in accordance with Decree No 25 of 1988 is charged with among others, the responsibility to acquire, construct and maintain dwelling houses, schools, communal and commercial buildings and other structures.

FHA has a parcel of land measuring about 675 hectares located at Kabusu District (Maitama II), FCT on which it plans to develop a Diaspora City for the Diasporans, upper-medium and high-income groups with various house types adopting the PSP delivery model. It also have portions of land at Bwari, Umuahia, Katsina and Gombe where residential housing with complimentary infrastructure shall be provided for the low, medium and high income groups. In line with the mandate of developing residential buildings, and its expanded role in the National Housing Policy 2012,

FHA hereby invites suitably qualified firms and/or consortium of firms, from those that expressed interest and had preliminary interaction with the Authority, to submit, Request for Qualification (RfQ) & for Proposals (RfP) to develop segments of the estate. Successful firm(s) with most responsive bids, shall be required to finance and develop site & services on portion of the estate and/or consequent construction of housing units in accordance with agreed specifications, tenure, terms and conditions to be set out in a Build, Finance & Transfer Agreement Upon development of the site & serviced lands/housing units, the successful investor(s) shall in conjunction with FHA sell to the general public and profits therefrom, shared by parties.

Prospective bidders should note that there are private proponents who had submitted proposal on the projects, however in order to ensure transparency, competition and value for money the projects will be procured under a “Swiss Challenge Procurement methodology” which requires that if the original project proponents for the respective projects are not the most responsive bidders, they will be given the right to match die most responsive bids in order to win. However, if it is unable to match the most responsive bid, the most responsive bid then wins the Swiss Challenge PPP procurement and becomes the preferred Project Proponent.

(2.0)       Project Objective

The overall objective of the project is to position the private sector and its market efficiency as well as financial and technical capabilities in our drive to ensure sustainability in supply of housing and its related infrastructure in the task of bridging the deficit in the country.

(3.0)       Project Scope

Interested firms and/or consortium of firms interest should submit RFQ and RFP for one lot only from the following lots and the most responsive bid then wins and becomes the preferred Project Proponent (s) per lot.

KABUSU (MAITAMA II) PHASE I

Lot 1 (Segment E): Development of complementary engineering Infrastructure on 50 hectares of land;
Lot 2 (Segment F): Development of complementary engineering infrastructure on 46 hectares of land;
Lot 3 (Segment G&H): Development of complementary engineering Infrastructure on 100 hectares of land;
Lot 4a (Segment!): Development of complementary engineering infrastructure on 30 hectares of land;
Lot 4b (Segment I): Development of complementary engineering Infrastructure on 23 hectares of land;
Lot 5 (Segment L): Development of complementary engineering Infrastructure on 51 hectares of land.

KABUSU (MAITAMA II) PHASE 11

Lot 6 (Segment E1): Development of residential houses on 20 hectares segment of the serviced land in line with the zoning plan and skyline requirement;
Lot 7 (Segment E2); Development of residential houses on 3 hectares segment of the serviced land in line with the zoning plan and skyline requirement;
Lot 8a (Segment E3); Development of residential houses on 1.5 hectares segment of the serviced land in line with the zoning plan and skyline requirement;
Lot 8b (Segment E3) Development of residential houses on 1.5 hectares segment of the serviced land in line with file zoning plan and skyline requirement;
Lot 9 (Segment F1): Development of residential houses on 15 hectares segment of the serviced land in line with the zoning plan and skyline requirement;
Lot 10 (Segment F2): Development of residential houses on 3 hectares segment of the serviced land in line with the zoning plan and skyline requirement

Lot 16 (Segment GH3): Development of residential houses on 10 hectares segment of the serviced land in line with the zoning plan and skyline requirement;
Lot 17 (Segment GH4): Development of residential houses on 3 hectares segment of the serviced land in line with the zoning plan and skyline requirement:
Lot 18 (Segment GH5): Development of residential houses on 3.1 hectares segment of the serviced land in line with the zoning plan and skyline requirement;

UMUAHIA

Lot: Development of residential houses with complimentary infrastructure on 50 hectares of land in line with the zoning plan and skyline requirement;

ENUGU

Lot: Development of residential houses with complimentary infrastructure on 26 hectares of land in line with the zoning plan and skyline requirement;

KATSINA

Lot: Development of 200 units of residential houses with complimentary infrastructure on part of land in line with the zoning plan and skyline requirement;

GOMBE

Lot: Development of 200 units of residential houses with complimentary infrastructure on part of land in line with the zoning plan and skyline requirement;

OSOGBO

Lot: Development of 200 units of residential houses with complimentary infrastructure on part of land in line with the zoning plan and skyline requirement;

(4.0) Eligibility Criteria and Method of Application

Qualification of Interested parties will be based on the following:

(4.1) Pre-Eligibility

(i)   Evidence of Company Registration with Corporate Affairs Commission (CAC) or its equivalent for foreign firms

(ii)  In the case of a consortium, evidence in fee form of letter of association or agreement (Joint Venture Agreement and/or Memorandum of Understanding/ Memorandum of Agreement).

(ii)  Power of Attorney/Board Resolution, in case of a consortium, identifying the lead member of the consortium authorized to submit the RFQ and binding on all the members of the consortium.

(iv)  Audited Financial Statements prepared in accordance with the International Financial Reporting Standards (IFRS) of the bidding company or members of consortium for the last three (3) years (2020, 2021 & 2022).

(v)  Tax Clearance Certificates for the last three (3) years (2020, 2021 & 2022).

(vi)  Sworn affidavit disclosing whether or not any officer of the relevant committees of the FHA is a former or present Director, shareholder or has any pecuniary interest in the bidder, that the company is not bankrupt, in receivership or under liquidation or involved in any litigation which can potentially affect the company’s ability to effectively discharge their responsibility if engaged and to confirm that all information presented in its bid are true and correct in all particulars.

(5.0) Tender Requirements

Technical, Operation and Financial capability including:

Detailed company/consortium profile:

(i)  A brief description of the company or consortium stating ownership structure, business history, management/organizational structure, residential estate development and financing capabilities, and any other relevant information.

(ii)  Ownership structure of bidding entity, Name(s) of major shareholders and percentage shareholding of participants in the bidding entity.

Experience of undertaking similar projects illustrated by the following;

(i)  General experience of development, construction and financing of housing projects globally/locally (list all relevant track records)

(ii)  Specific Experience and track records of design, construction and financing of housing Projects globally/locally (list all relevant trade records)

(iii)  Evidence of developing a housing project of at least 25 houses.

(iv)   Experience of housing development in Nigeria (Experience of housing development in Abuja would be an advantage)

(v)  Design, construction, financing and delivery of a large-scale housing project in Nigeria would be an added advantage.

Evidence of financial capacity, in support of the company or consortium’s ability to undertake the development of the listed Housing Estate in partnership with FHA, illustrated by:

(i)           Turnover of at least Two Billion Five Hundred Million Naira (N2.5 billion) per annum for FCT projects and One Billion Five Hundred Million Naira (N1.5 billion) per annum for other locations.

(ii)          Evidence of adequate financial resources to finance investment Interested applicants must have a minimum net worth of at least One Billion Five Hundred Million Naira (N1.5 billion) or its equivalent as shareholders equity contribution for FCT Projects and Five Hundred Million Naira (N500 million) for other locations.

(6.0) METHOD OF SUBMISSION

All applications shall be submitted physically.

(i) Submission should be separately package in sealed envelopes, marked as either TECHNICAL BID or FINANCIAL BID and put in a single (bigger) envelope, addressed and submitted to the Office of the General Manager, P&ZC, Federal Housing Authority, No 26 Julius Nyerere Crescent, Asokoro, Abuja; the application shall consist of three (3) printed and bound copies ( 1 Original and 2 Copies) in a sealed and signed envelope clearly marked “Name of Company/Consortium”, Project Title and a soft copy submitted in a flash drive.

(ii)  Deadline for physical submission is two (2) weeks from the date of this notice i.e 12:00 Noon on Monday, 6 November, 2023.

(iii) Only bidders who meet the minimum criteria will be invited for the opening of Financial Bids at a later date
