EXPRESSION OF INTEREST FOR RETENDER

The Nigerian Electricity Regulatory Commission (NERC) is the regulatory body that see through the activities of the entire value chain of the electricity market in Nigeria and in accordance with the Order on Procurement by Successor Electricity Distribution Licensees (DisCos) for the execution of the capital projects with the Central Bank of Nigeria (CBN) CAPEX loan, all Electricity Distribution Licensees ore mandated to engage the services of qualified and competent potential bidders to ensure the execution of Capital Projects within their franchise network.

EKEDC hereby invites reputable companies to participate in the prequalification process of contractors to execute its CAPEX projects. Through this process, EKEDC Seeks to engage with companies interested in partnering with us for the implementation of our performance improvement projects.

SCOPE OF OPERATIONS AND SERVICES

The scope of the performance improvement projects shall include the following

1 EKEDC/PRJ/007/2022 Segregation of NRC 33KV line from Akangba-LUTH/Idi-Araba 33KV line and a new feeder ex-Lekki TS to relieve Elegushi and Water front 33KV feeder.

 

ELIGIBILITY CRITERIA AND REQUIRED DOCUMENTATION

Interested applicants are hereby requested to submit the following to fulfill the mandate requirements:

(1)          Detailed company profile: description of the company (or companies in the case of a consortium) stating the firm’s ownership, management structure operational capacity, past and present clientele (relevant to this field and above listed projects) and any other relevant information.

(2)          Certificate of incorporation from the Corporate Affairs Commission (CAC) together with certified true copies of the following:

·         Form CAC 2 (statement of share capital and return allotment of shares.

·         Form CAC 7 (particulars of directors or any change therein)

·         Most recent CAC 10 (form of annual returns)

·         Memorandum and Articles of Association

(3)          Evidence of company’s financial capacity (audited accounts for the last three (3) years and tax clearance certificate.

(4)          Three (3) references from whom the applicant has provided services flee the projects listed above. Kindly include the contact person, job title and current phone number. Completion certificates to be included.

(5)          Evidence of partnership with a relevant/applicable original equipment manufacturer and/or manufacturing facility to ensure the capacity for project execution.

(6)         Profile and relevant experience of key management staff.

(7)         Evidence of Current Industrial Training fund (ITF) Compliance Certificate.

(8)         Applicants are required to be registered vendors of EKEDC. Companies not registered can begin the process by sending email to contractprocurement@ekedp.com kindly input “EKEDP CBN CAPEX 2023” as the reference in the statement of interest for easy identification.

(9)  Applicants are required to have executed similar projects in the value of  Fifty Million Naira or above.

(10) Applicants should not be backlisted by any Government Companies Government Organisations, Government Agencies as well as private companies.

(11) Duly signed letter of endorsement, certified bank statement and detailed credit from a reputable bank.

(12)  All relevant NEMSA Certificates

(13)  Evidence of compliance with the provisions of the Pension Act Reform Act 2004 for Nigerian companies.

(14)  Current and approved health, safety, and environment manual with signed policies.

(15)  Evidence of firm’s registration with relevant professional bodies (where applicable).

(16)  Provision of all past and current Lagos State Government permits such as but not limited to Right of Way.

(17)  Affidavit to the following effect:

–  The company is not in receivership, insolvency, or bankruptcy.

–  Audited accounts of the applicant for the lost three (3) years ore duty endorsed by a firm of Chartered accountants.

–  The company does not have any Director who has been convicted by any court in Nigeria or any other country for criminal offence in relation to fraud or financial impropriety.

–  No officer of Eko Electricity Distribution Company is a present or former Director or Shareholder or has any pecuniary interest in the company.

–  All the documents submitted for the prequalification bid are not only genuine but correct.

–  They follow oil the laws of Nigeria and its country of incorporation.

METHOD OF SUBMISSION

All applicants are required to submit Expression of Interest letters alongside the requested supporting documents as applicable by hand to the Supply Management and Sourcing (Procurement Unit) Department located at the Corporate Headquarters 24/25 Marina Road Lagos Island. Electronic submissions are encouraged to the underlisted email address not later than two (2) weeks (10 working days) from the day of this publication. (12 December, 2023)

IMPORTANCE NOTICE

It is mandatory that all documents must be submitted with a Covering/Forwarding Letter under the Company/Firm’s letter headed Paper bearing amongst others, Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterheaded Paper must bear the Names of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

The Expression of Interest does not place any obligation on EKEDC to consider any/all applicant(s) for contract award. All costs incurred because of this prequalification process shall be borne by the Applicants.

Late submission will not be accepted, and only short-listed companies will be contacted.
